The protection of your personal data is an important concern for us. Below you will find out how we deal with your personal data. We differentiate between your visit to our website (see I. below) and the data generated in the process, and any other contact you make with us, e.g. by telephone, email or at our premises (see II. below). I. Visit to our website

When you visit our website, we process your personal data as follows:

1.The collection and storage of personal data, as well as the nature and purpose of their use
When you visit our website www.asw24.de, the browser used on your device automatically sends information to our website’s server. This information is stored temporarily in a so-called log file. The following information is collected without any action on your part and stored until it is automatically deleted:

  • the IP address of the accessing computer,
  • the date and time of the access,
  • the name and URL of the file accessed,
  • the website from which the access was made (referrer URL),
  • the browser used and, if applicable, your computer’s operating system as well as the name of your access provider.

We process the above data for the following purposes:

  • ensuring that the website connects without any problems,
  • enabling the user-friendly operation of our website,
  • evaluating the system’s security and stability
  • further administrative purposes.

The legal basis for the data processing is Art. 6 Para. 1 S. 1 lit. f GDPR. Our legitimate interest arises from the data collection purposes listed above. Under no circumstances do we use the collected data to draw any conclusion about you as a person.
Furthermore, we use cookies when you visit our website.

2.Cookies

We use cookies on our website. These are small files that are automatically created by your browser and stored on your device (laptop, tablet, smartphone, etc.) when you visit our website. Cookies do not cause any damage to your device and do not contain any viruses, Trojans or other malware.

The cookie stores information that results in each case in connection with the specifically used device.

However, this does not mean that this directly provides us with knowledge of your identity. The use of cookies serves, on the one hand, to make the use of our services more convenient for you. For example, we use so-called session cookies to recognise that you have already visited individual pages on our website. These are automatically deleted after you leave our website.

In addition, in order to optimise user-friendliness we also use temporary cookies, which are stored on your device for a specified period of time. If you visit our site again to use our services, it is automatically recognised that you have already visited us and which entries and settings you have made, so that you do not have to enter them again.

We also use cookies to record the use of our website statistically. Your data is used exclusively in anonymised form.

The data processed by cookies as described above is required for the purposes mentioned to safeguard our legitimate interests in accordance with Art. 6 Para. 1 S. 1 lit. f GDPR, and is therefore legitimate even without consent.

Most browsers accept cookies automatically. You will be asked for your consent to the use of cookies when you visit our website. Regardless of this, you can configure your browser so that no cookies are stored on your computer, or a message always appears before a new cookie is created. However, completely deactivating cookies may mean that you will be unable to use all the functions of our website.

3.Analysis tools

We do not use any analysis tools in addition to the cookies mentioned above under Point 2.

4.Social media plug-ins

We do not use plug-ins from the social networks Facebook, Twitter or Instagram on our website.

5.Use of our contact form

If you have any questions, we offer you the opportunity to contact us using a form provided on the website. To do so, you must provide a valid email address so that we know who sent the enquiry and can respond to it. Further information can be provided voluntarily.

In accordance with Article 6 Para. 1 Sentence 1 lit. a of the GDPR, we process data entered for the purpose of making contact with us on the basis of your voluntarily granted consent.

The personal data collected by us for the use of the contact form will be automatically deleted after your enquiry has been dealt with.

II. Data processing when we are contacted outside our website

If you contact us outside of our website, we will process your data depending on the type and/or purpose of the contact in accordance with the following information:

1.Data processing when we are contacted by phone, email or similar/dealer enquiries

In the course of our contact with you, whether by telephone, email, at our premises or in any other way, you will necessarily provide us with personal data, in particular your name, address and other contact details (telephone, email, fax) and data relating to your business operations. Below you will find out how we process this data.

We process the above-mentioned personal data (your name, address and other contact data (telephone, email, fax) for the purpose of fulfilling the contract and advertising our products to you. In particular for

  • the processing of your order or enquiry
  • our own analyses and statistical purposes
  • the optimisation of our range of services

The legal basis for the processing of an order or enquiry is Art. 6 Para. 1 lit. b GDPR. Processing for the purpose of advertising our products is justified due to our legitimate interest in advertising our products in accordance with Art. 6 Para. 1 lit. f GDPR. This also applies to processing for our own analyses and statistical purposes, and for optimising our range of services.

We would like to point out that we may pass on your data to third parties as part of a creditworthiness enquiry.

2.Data of contact persons/officials of public authorities

We store the contact details (surname, first name, address, telephone number, email address, company affiliation) of the contact persons of our customers for the purpose of direct contact in the context of the preparation and fulfilment of contracts.  The same applies to the contact details of public authority officials in the context of contacting them for official measures.

The legal basis for the processing is Art. 6 Para. 1 S.1 lit. f GDPR. We have a legitimate interest in processing the personal data required for this in the interests of simplified and, in particular, direct contact with the relevant contact persons.

3.Data processing for applications and in the application process

In the context of applications, we collect and process the personal data of applicants for the purpose of conducting the application process. The legal basis for the processing is Art. 88 GDPR in conjunction with § 26 of the Federal Data Protection Act (BDSG). Processing can also be carried out electronically.

This is particularly the case if an applicant submits corresponding application documents to us electronically, for example by email or via a contact form on the website. If we conclude a contract with an applicant, the transmitted data will be stored for the purpose of processing the contractual relationship in compliance with the applicable statutory provisions. The legal basis for this results from Art. 6 Para. 1 lit. b GDPR.

4.Processing the data of existing customers – advertising, Christmas greetings

If you have provided us with your email address in connection with the conclusion of a contract, we will also use this address as well as your salutation and surname to send you information about our own products and/or services that are similar to the products/services you have purchased from us. We also use this data to send you our Christmas greetings. The precondition is that you have not objected to the use of your email address for advertising purposes.

The legal basis for the processing is Art. 6 Para. 1 S.1 lit. f GDPR in conjunction with § 7 Para. 3 of Germany’s Act Against Unfair Competition (UWG). We have a legitimate interest in informing our existing customers about our products and services and in sending you Christmas greetings in the interests of customer loyalty. The customers’ interests are sufficiently taken into account by the right of revocation to which they are entitled (see III.3. below), and of which they are informed in every email.

5.Data processing in the context of complaints in accordance with § 9 (11-13) of the General Product Safety Regulation (GPSR)

If you file a complaint about a product with us in accordance with Art. 9 (12) of the EU General Product Safety Regulation (GPSR) or if you inform us about accidents or safety issues that have occurred in connection with one of our products, we will use this data solely to process/check your complaint or information. In connection with your notification, we only store the personal data that we need in order to be able to check its contents. The data will be stored for as long as required for the check, but for no longer than five years from the date of entry of the corresponding data.

The legal basis for the processing is Art. 6 Para. 1 S.1 lit. c GDPR in conjunction with Art. 9 Paragraphs 12 and 13 of the General Product Safety Regulation (GPSR). We are legally obliged (Art. 9 Paragraphs 11 and 12 of the General Product Safety Regulation (GPSR)) to accept and investigate complaints. For this purpose we need the personal data mentioned above.

III. Further information

1.Disclosure of data to third parties – categories of recipients

a) We do not disclose your personal data to third parties for purposes other than those listed below. We only disclose your personal data to third parties if at least one of the following conditions is met:

  • you have given your express consent to this in accordance with Art. 6 Para. 1 S. 1 lit. a GDPR,
  • it is legally permissible and, in accordance with Art. 6 Para. 1 S. 1 lit. b GDPR, is necessary for the processing of contractual relationships with you,
  • the disclosure is required under Art. 6 Para. 1 S. 1 lit. f GDPR to assert, exercise or defend legal claims and there is no reason to assume that you have an overriding legitimate interest in your data not being disclosed,
  • if there is a legal obligation to transfer the data in accordance with Art. 6 Para. 1 S. 1 lit. c GDPR.

b) Your data will be disclosed to the following categories of recipients:

courts, administrative authorities, other authorities, insurance companies (e.g. liability insurance)

c) No data is transferred abroad.

2.Data subject rights

You have the following rights:

  • In accordance with Art. 15 GDPR, to request information about your personal data that we process. In particular, you can request information about the purposes of the processing, the category of personal data, the categories of recipients to whom your data has been or will be disclosed, the planned retention period, the existence of a right to rectification, deletion, restriction of processing or objection, the existence of a right to complain, the origin of your data if it has not been collected by us, and the use of automated decision-making including profiling and, where applicable, meaningful information about the details of such processing.
  • In accordance with Art. 16 GDPR, to request the immediate correction of incorrect or incomplete personal data stored by us;
  • In accordance with Art. 17 GDPR, to request the deletion of your personal data stored by us, unless the processing is necessary to exercise the right to freedom of expression and information, to fulfil a legal obligation, for reasons of public interest or to assert, exercise or defend legal claims;
  • In accordance with Art. 18 GDPR, to request the restriction of the processing of your personal data if you dispute the accuracy of the data, if the processing is unlawful but you oppose the deletion of the data and we no longer need the data, but you require it for the assertion, exercise or defence of legal claims, or if you have objected to the processing in accordance with Art. 21 GDPR;
  • In accordance with Art. 20 GDPR, you have the right to receive the personal data that you have provided to us in a structured, commonly used and machine-readable format, or to require its transmission to another controller;
  • In accordance with Art. 7 Para. 3 GDPR, you have the right to revoke your consent to us at any time. This means that we will no longer be allowed to continue the data processing based on this consent in the future.
  • In accordance with Art. 77 GDPR, you have the right to file a complaint with a supervisory authority. As a rule, you can contact the supervisory authority at your usual place of residence or workplace, the location of holiday accommodation or our place of residence.

 3.Right of objection

If your personal data is processed on the basis of legitimate interests in accordance with Art. 6 Para. 1 S. 1 lit. f GDPR, you have the right to object to the processing of your personal data in accordance with Art. 21 GDPR, provided that there are reasons for doing so that arise from your particular situation or the objection is directed against direct mail. In the latter case, you have a general right of objection, which we will implement without you having to specify a particular situation.

4.Assertion of the right of revocation or objection

If you wish to exercise your right of revocation or objection, you can do so informally, e.g. by sending an email to info@asw24.de.

5.Retention period

The data will be deleted as soon as it is no longer required for the purpose of its processing.

If you make an enquiry without placing an order, your data will be deleted after 15 months at the latest. In all other cases, your data will be stored in accordance with the statutory retention requirements and deleted immediately after these obligations have expired.

We only store personal data that we process based on your complaint/notification in accordance with the General Product Safety Regulation (Art. 9) for as long as this data is necessary to review your notification. Under no circumstances will we store this data for longer than five years from the date of your notification, unless you have given us your express consent to do so.

6.Data security

When you visit our website, we use the standard SSL (Secure Socket Layer) method in conjunction with the highest level of encryption supported by your browser. This is usually 256-bit encryption. If your browser does not support 256-bit encryption, we use 128-bit v3 technology instead. You can tell whether an individual page of our website is being transmitted in encrypted form by the closed display of the key or lock symbol in the lower status bar of your browser.

We also use appropriate technical and organisational security measures to protect your data against accidental or intentional manipulation, partial or complete loss, destruction or unauthorised access by third parties. Our security measures are continuously improved in line with technological developments.

7.Updates and changes to this privacy policy

This privacy policy in its current version is valid with effect from May 2018.
